1. Acceptance of these Terms

This website, mahi-sports.com (the “Website”), is owned and operated by Mahi Enterprise, a sole proprietorship (referred to as “Mahi Sports”, “we”, “us” or “our”). By accessing or using the Website, creating an account, or submitting a purchase request, you (“you”, the “User” or the “Customer”) agree to be bound by these Terms & Conditions and by our Privacy Policy, Refund & Returns Policy and Shipping Policy, which form part of these Terms. If you do not agree, please do not use the Website.

2. Changes to these Terms

We may amend these Terms from time to time. The current version, together with its “Last updated” date, is always published on this page and takes effect upon publication. Your continued use of the Website after a change is posted constitutes acceptance of the amended Terms. For material changes affecting pending orders, the terms in force at the time your order was confirmed will apply to that order.

3. Orders: purchase requests and confirmation

The Website is an online catalogue. Placing an order through the Website constitutes a purchase request — an offer by you to buy the listed products. It does not, by itself, create a binding contract of sale.

• After you submit a purchase request, our manager will contact you by phone or email to verify the items, quantity, delivery address and total amount.
• A contract of sale is formed only when we expressly confirm your order during that contact.
• No online payment is collected on the Website. Payment instructions (such as bank transfer or UPI details) are shared by our manager after the order is confirmed. Where available, Cash on Delivery may be offered, in which case payment is made to the courier on receipt.
• We may decline or cancel a purchase request in cases including, without limitation, product unavailability, a pricing or listing error, inability to reach you for confirmation within 3 business days, or suspected fraud. If any amount has already been paid for an order we cancel, it will be refunded in full.

4. Prices and availability

All prices on the Website are quoted in Indian Rupees (₹) and, unless stated otherwise, are inclusive of GST. Shipping charges, if applicable, are stated separately and communicated before your order is confirmed.

• We make reasonable efforts to keep prices and stock information accurate, but errors and stock changes can occur. We reserve the right to correct prices and availability at any time before an order is confirmed by our manager.
• Once an order is confirmed, the confirmed price will not be increased for that order.
• If a product was listed at an evidently incorrect price due to a typographical or system error, we may cancel the purchase request and will notify you.

5. User account

You may browse the Website without an account, but an account may be required to place and track orders. When registering, you must provide accurate and current information and keep it up to date.

• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Notify us immediately at info@mahi-sports.com if you suspect unauthorised use of your account.
• We may suspend or terminate accounts used in breach of these Terms, for fraudulent activity, or as required by law.
• The Website is intended for users who are 18 years of age or older, or who use it under the supervision of a parent or legal guardian.

6. Acceptable use

You agree not to:

• use the Website for any unlawful purpose or in breach of any applicable law of India;
• submit false purchase requests, impersonate another person, or provide inaccurate contact or delivery details;
• attempt to gain unauthorised access to the Website, its servers or databases, or interfere with its operation (including by scraping, probing or introducing malicious code);
• copy, resell or commercially exploit any part of the Website or its content without our prior written consent.

7. Product information and warranties

Product descriptions, specifications and images are provided by manufacturers or distributors and are for general reference. Actual products may vary slightly (for example, in colour rendering or packaging revisions). Manufacturer warranty, where applicable, is stated on the product page and is serviced under the terms of the respective brand’s warranty policy in India. Nothing in these Terms limits your statutory rights under the Consumer Protection Act, 2019.

8. Intellectual property

All content on the Website — including the Mahi Sports name and logo, page layouts, text, graphics, product curation and software — is owned by or licensed to Mahi Enterprise and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws. Third-party brand names and logos shown on product pages belong to their respective owners and are used solely to identify the products offered for sale. You are granted a limited, non-exclusive, revocable licence to access the Website for personal, non-commercial use; no other rights are granted.

9. Limitation of liability

To the maximum extent permitted by applicable law:

• the Website and its content are provided on an “as is” and “as available” basis, and we do not warrant that the Website will be uninterrupted or error-free;
• we shall not be liable for indirect, incidental, special or consequential losses, including loss of profit, data or goodwill, arising from your use of the Website;
• our aggregate liability in connection with any confirmed order shall not exceed the amount actually paid by you for that order.

Nothing in this section excludes or limits liability that cannot be excluded under Indian law, including liability under the Consumer Protection Act, 2019.

10. Indemnity

You agree to indemnify and hold harmless Mahi Enterprise, its directors, officers and employees from any claim, demand or loss (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Website.

11. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to any mandatory consumer-protection provisions granting jurisdiction elsewhere, the courts at the place of our registered office shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Website.

Questions about these Terms, and any consumer grievances, may be addressed to our support team using the details below. We aim to acknowledge grievances within 48 hours and resolve them within 15 days of receipt.
